Chapter 299: Continuing to Explain the Plot

~4 min read 762 words

Continuing to explain the plot.

Continuing to explain the plot.

Good news, the last time I opened a single chapter to explain the plot was the last time!

Some book friends really don't understand this plot and have posted many comments questioning it, so let me explain the main points of contention.

The first is why the protagonist acts this way. I read the replies from book friends and feel that the protagonist previously mentioned triple compensation, and there is insurance, so let him go through the process, but the protagonist is unwilling. Why? Because he feels it is troublesome and feels it is wrong. Why should I be the one to go find your insurance? Shouldn't it be that you pay yourself or you find the insurance? A point that needs to be emphasized here is that it is not because of the money, but because this insurance is different from the car insurance cited by book friends. In car insurance, both parties are people, their rights and obligations are the same, and there are specific regulations such as the Road Safety Law, so those regulations must be followed.

Taking a step back, even with car insurance, it is impossible to say that after an accident occurs, you tell me to call the Insurance Company to argue about it. I would always have to find the insurance first, and after I have made things clear with my insurance, then let my insurance repair the car or pay the compensation for you. The one who should be arguing with the insurance is me, not the other party.

Not to mention that here, finding the insurance is a platform rule, but according to the Food Safety Law and the Consumer Rights Protection Law, one must first find the merchant. Whoever sells the goods and has a problem, you find them.

This cannot be simply understood as not wanting to do it, but as a question of assuming obligations. What is the purpose of a merchant buying insurance? One of the reasons is for their own convenience, but instead, it requires the consumer to go and argue with the insurance. Is this fair to the consumer? This way the merchant is fine, and the consumer has to argue for a long time to get the claim settled. This is equivalent to kicking all obligations directly to the insurance and the consumer. You must know that this obligation to argue with the insurance is originally something the merchant should do. The protagonist doesn't want the trouble, so he wants to be direct.

Here, the insurance for dining as I understand it should be a contractual relationship generated between the merchant and the Insurance Company itself. It is a compensation for the merchant themselves after a problem occurs, not to mention that the Food Safety Law and the Consumer Rights Protection Law both have clear provisions.

As for the question of the protagonist being a strong person... there is no way to answer, because the protagonist has a system and Fang Dazhuang, so must he go and confront those big companies and big enterprises? I don't think so, because this is another form of moral kidnapping.

Second, the issue of Transfer of Burden of Proof and Reversal of Burden of Proof. Some people say, isn't the merchant just going to be a victim of Extortion? One point needs to be emphasized: consumers and operators are legally unequal. Why is it called the Consumer Rights Protection Law and not the Merchant Rights Protection Law? Not to mention that Extortion is easy to violate the crime of Extortion, consumers cannot open the box every time, but merchants can install Monitoring and record the food production process. This is the most direct evidence. Many people will feel that the merchant is very aggrieved and needs to engage in Self-Proving Innocence, but food and medicine are very special, and there are other durable goods like computers where it is difficult for consumers to provide evidence, and it is unreasonable. Conversely, it is easier for the producer or operator to prove it than for the consumer, so Reversal of Burden of Proof and Transfer of Burden of Proof are needed.

Finally... the above is actually all nonsense. After all, this is a novel, and what everyone likes to see is definitely confronting the strong and feeling super satisfied, so I am also struggling with whether to shorten this plot, it's just that there have always been book friends who want me to write about these issues... struggling.
